Terms & Conditions

The present General Terms of Sale (GTS) govern all orders and sales made by the Customer to the company Irmãos Pereira Pacheco, S.A. (IPP) – Pacheco’s Mobiliário brand.

IPP reserves the right to change without notice measures, materials and the value of the points shown in the technical table and its catalogues.

VAT (Value Added Tax) is not included in the prices. This will be added at the rate in force.

IPP warns that the delivered furniture may present colour variations in relation to the samples as well as small variations in measurements, either due to variation in the raw material or environmental factors (luminosity, humidity, etc…). IPP cannot guarantee the accuracy of colours between orders.

Intellectual Property

The products designed and manufactured by IPP – Pacheco’s Mobiliário brand are protected by trademark and patent copyright, being exclusive property of IPP. Any practices that attempt their imitation or reproduction without express authorization of IPP are expressly forbidden.

All customers who wish to use IPP’s brand and products in any form of advertising (outdoors, trade shows and/or other purposes) must previously request that IPP issue a written authorisation for this purpose.

Special and Custom Made Parts

For special and made-to-measure pieces, the Customer should consult IPP about its viability and respective quotation. In all orders it is essential that the Customer attaches a composition drawing and an indication of the materials and finishes required. Cancellations of special and made-to-measure parts will not be accepted from the moment the order is validated and enters production.

Payment Terms

Payment terms are those agreed between the Client and IPP and mentioned in the respective invoices.

Orders and deliveries

Customer orders must be sent to IPP in writing (fax or email) in a clear and legible form, duly signed and whenever possible accompanied by a sketch.
After confirmation of orders by IPP, the Client has 48 hours (forty eight) to proceed with cancellations and/or modifications. After this period, no modifications or cancellations will be accepted unless expressly accepted in writing by IPP.
The costs and means of transport are those agreed between the Customer and IPP.

Complaints

Complaints must be submitted in writing to IPP within 15 days after delivery of the furniture. After this period, complaints will not be accepted.
IPP commits to repair or exchange, as soon as possible, any parts or pieces which present defects attributable to the factory, as long as the client returns the defective parts.
Anomalies verified during unloading must be immediately registered on the CMR or on the document that accompanies the transport, otherwise they will not be accepted later.

Warranty

IPP furniture is contractually guaranteed against all manufacturing defects for a period of 2 (two) years from the date of delivery. This warranty includes the repair or replacement of the parts recognised as defective and the labour required for such repair or replacement. The electrical systems are guaranteed for 6 (six) months from the date of delivery.

The warranty does not cover damage caused during transport (where the customer is responsible), rough handling, vandalism, unauthorised repairs, modifications, misuse, negligence or accidents.

Conferral of Jurisdiction

In case of dispute, it is expressly agreed between both parties that the law to be applied is the Portuguese Law and the Court of the District of Paços de Ferreira – Portugal is designated as the competent court.
